“Discover Dubai Card” means Discover Dubai UAE.“Website” means Please read these Terms and Conditions carefully before entering into the contract and buying the Discover Dubai Card .The use by you of the Website and the purchase of the Discover Dubai Card through the Website is conditional upon your acceptance of these Terms and Conditions (the “Terms”). You should understand that by ordering a Discover Dubai Card, you agree to be bound by these Terms and Conditions.We reserve the right to amend these Terms and Conditions at any time by posting the amended terms and conditions on our site You should check the Website from time to time to review the current legal notice, because it is binding on you. Certain provisions of this legal notice may be superseded by expressly designated legal notices or terms located on particular pages of the Website.

2. Purchasing Products
We negotiate and advertise offers, products, experiences,and any other promotional based offerings (collectively, the “Offer”) with various suppliers of goods and services on behalf of our customers. The Offers are conditional upon certain requirements being met and may have specific terms and conditions attached to them, which will be displayed in relation to any specific Offer on the Website. Upon receipt of confirmation from our third party payment service provider (“Paypal” and ” Stripe”) that they have received your payment for the Discover Dubai Card, we shall issue you with the Discover Dubai Card. We are not the supplier of the goods and/or services under the Offer, the supplier of the goods or services will be a third party (the “Merchant”).The Merchant will be solely responsible for supplying the offer. The Merchant has agreed with us that it will supply the offers bought through the Website on presentation of the Discover Dubai Card.
3. Your status
By placing an order for a Discover Dubai Card through our site, you confirm that:
(a)You are legally capable of entering into binding contracts
(b)You are at least 18 years old.
(c)You grant us an irrevocable, non-exclusive licence to use for any purpose any content you post on the Website or which is otherwise communicated to us via any media.
4. How the contract is formed between you and us.
After placing an order for a Discover Dubai Card and upon receipt of your payment by Paypal or Stripe following your purchase of the Discover Dubai Card via the Website, we shall confirm your order by sending an e-mail from us acknowledging that we have received your order. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that a Discover Dubai Card has been dispatched, or in the case of a digital Discover Dubai Card purchase, that payment has been accepted. The contract between us will only be formed when we send you a dispatch confirmation for the Discover Dubai Card or a confirmation of acceptance of payment for the digital Discover Dubai Card.
5. Your personal data and data protection
By placing an order and purchasing the Discover Dubai Card through the Website, you agree to provide only accurate and complete registration information and you will keep that information up to date if it changes. You must never use another Website user’s account without obtaining their prior consent. You are solely responsible for any and all access to the Website by persons using your account and so we suggest you keep your account password secure. You must notify us immediately if you become aware of any unauthorised use of your account.
Discover Dubai Card may use all the information that you supply to us in purchasing a Product (such as your name, address, email address, telephone number, etc.) for the purposes of:
completing the transaction;
sending you news of our special events, offers, promotions and newsletters either by post, email, SMS or through any social network (you can manage your preferences using your user account and can opt out of receiving such communications at any time); and
6. Our status
The Merchant is the seller of the goods and/or services under the Offer and is solely responsible for ensuring the Offer and the goods and/or services are performed and comply with all applicable law.
Discover Dubai Card obligations under these Terms are solely to issue the Discover Dubai Card to you under the Offer. Discover Dubai is not the seller of such goods and/or services and the Merchant is solely responsible for supplying such goods and/or services and redeeming any such Product in respect of the same pursuant to their terms and conditions of sale.
Discover Dubai disclaims any and all responsibility or liability in relation to the Offer or for any goods or services supplied in relation to it to the maximum extent permissible by law. Neither Discover Dubai nor its officers, employees or any third parties may be held liable whether in relation to contract, warranty, tort (including negligence), product liability, tax matters or any other form of liability for any claim, damage or loss, arising from or relating to the provision of all or any goods or services sold or agreed to be supplied pursuant to the Offer.
We may provide links on our site to the websites of other companies, whether affiliated with us or not. We cannot give any undertaking, that products you purchase from third party sellers, or from companies to whose website we have provided a link on our site, will be of satisfactory quality, and any such warranties are disclaimed by us absolutely. This disclaimer does not affect your statutory rights against the third party seller and/or the Merchant. Discover Dubai Card may disclose the customer information that you provided when purchasing the Product to the Merchant, if this is required for the Merchant to provide you with the Product.
Following your purchase of the Discover Dubai Card you will receive a confirmation email about the purchase of your personalised Discover Dubai Card. You agree that the right to cancel your Discover Dubai Card within 14 days of entering into the contract to purchase the Discover Dubai Card under the law does not apply to your contract.
We are unable to modify, exchange or offer refunds and cancellations for this date specific Card as once issued to you, we are unable to re-sell this Discover Dubai Card.
8. Price and Payment
The price of the Discover Dubai Card will be as quoted on the Website. These prices include VAT. If there is an obvious pricing error in relation to the Discover Dubai Card which could have reasonably been recognised by you as a mispricing then we have the right to cancel the purchase of the Discover Dubai Card and issue you with a refund in respect of the same.
The price of the Discover Dubai Card are liable to change at any time, but changes will not affect orders in respect of which we have already sent you confirmation.
Payment must be by Paypal, Stripe or by such other method as we may agree from time to time.
9. Third Party Payment Processing
https://www.paypal.com/uk/webapps/mpp/ua/privacy-full. Discover Dubai Card shall not be liable for any actions or omissions committed by Paypal.
10. Cancellation by Discover Dubai
In the unlikely event that Discover Dubai Card has to change, cancel or reschedule a date for the Discover Dubai Card due to events beyond Discover Dubai Cards reasonable control, a full refund will be given to you. Discover Dubai Card will not, however, refund travel, accommodation or any other costs that you may have incurred over and above the fee paid for the Product.
11. Availability and delivery
You will receive your Discover Dubai Card within 7 working days of our confirmation, unless there are exceptional circumstances. The Digital Card/ App will be downloaded immediately.
Once your order has been accepted we aim to despatch your personalised Discover Dubai Card within 3 working days unless you are otherwise advised. If you do not receive your Discover Dubai Card you must contact us within 7 days. If you do not contact us within the 7 days any replacement Card that is issued will carry a £5 administration fee and be issued with the original expiry date.
Please note – If you are registering for a digital only Discover Dubai Card which is accessed via the App, you will not receive a physical Discover Dubai Card.
12. Participating merchants and use of your Discover Dubai Card
On presentation of your Discover Dubai Card, participating Discover Dubai Card Partner venues and merchants will provide you with the benefit of the deal on offer, for example but not limited to, offering up to 60% off your bill , 2for1 or a discount (the cheapest item will be deducted from the bill) .
Participating merchants may exclude Fridays, Saturdays, bank holidays.Christmas Eve, Christmas day, New Years eve, New Years day, Eid Al Adha, UAE National Day. During Ramadhan some outlets might have limited service. Please check our site for further details. Please refer to individual merchant pages as other exclusions may apply. Discover Dubai cannot be held liable for the change of service.
If a participating restaurant has a telephone icon listed on its page on our site or in the guide, advance bookings must be made and therefore you should mention at the time of booking that you intend to use the Discover Dubai Card. Discover Dubai Card shall use all reasonable efforts to keep the Website updated with particulars of participating merchants and their terms of availability using the Discover Dubai Card.
Offers advertised on our site are only available to customers who present their Discover Dubai Card. Such offers are not available in conjunction with any other offers that participating merchants may be running, which may include set menus or any other menus other than the standard a la carte menu.
The expiry date of each Discover Dubai Card will vary and will always be checked at each venue. Expired Discover Dubai Cards are not accepted by participating venues. Discover Dubai Cards are strictly non-transferable and can only be used by named customer. Any attempted misuse of Discover Dubai Cards may result in confiscation.
We shall regularly update our site to show the particulars of participating merchants and their terms.Participating merchants may, however, be entitled to withdraw from the Discover Dubai Card scheme or to change the terms and conditions after you have purchased the Discover Dubai Card. We shall have no liability for any such withdrawals or changes in terms and conditions or availability. Customers will have the benefit of any additional merchants who join the Discover Dubai Card scheme at a later date.
Offers advertised on the Website are not available in conjunction with any other offers the merchant might be running. The expiry date of your Discover Dubai Card will be checked by the participating merchant when you redeem the offer. Expired Discover Dubai Card will not be accepted. The Discover Dubai Card is strictly non-transferable. We will use reasonable endeavours to ensure the Website is kept up to date to show a full portfolio of discounts and benefits available. Merchants are entitled to withdraw their offer, or change the terms and conditions of their offer after you have purchased the Discover Dubai Card. Discover Dubai Card shall have no liability for any such withdrawals or changes in the Terms and Conditions. Discover Dubai Card holders will have the benefit of any additional participating merchants who join the Discover Dubai Card at a later date.
14. Our Liability
14.1 Subject to clause 14.3, if we fail to comply with these terms and conditions, we shall only be liable for the purchase price of the Discover Dubai Card.
14.2 Subject to clause 14.3, we will not be liable for losses that result from our failure to comply with these terms and conditions that fall into the following categories:
14.2.1 loss of income or revenue;
14.2.2 loss of business;
14.2.3 loss of profits; or
14.2.4 loss of anticipated savings.
14.3 Nothing in this agreement excludes or limits our liability for:
14.3.1 death or personal injury caused by our negligence;
14.3.2 fraud or fraudulent misrepresentation;
14.3.3 any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; or
14.3.4 any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.
14.4 Any losses or liability arising out of, or in connection with the merchants offer shall be the relevant merchants liability. We accept no liability for any bad experiences or bad food at any of the participating merchants. We will not become involved in any dispute between you and any merchant.
14.5 We do not give any warranty for any goods or services accessed through, or displayed on, our site.
15. Written communication
Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
All notices given by you to us must be given to The Operations Director at info@Discoverdubaiuae.com. We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified in clause 11 above. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.
Failure by us to enforce any of these terms and conditions will not prevent us from subsequently relying on, or enforcing, them.
If any court or competent authority decides that any of the provisions of these terms and conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.
19. Third party rights
15.1 A person who is not party to these terms and conditions shall not have any rights under or in connection with it under the Contracts (Rights of Third Parties) Act 1999.
20. Entire agreement
These terms and conditions and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of these terms and conditions. We each acknowledge that, in entering into these terms and conditions, neither of us relies on, or will have any remedies in respect of, any representation or warranty (whether made innocently or negligently) that is not set out in these terms and conditions or the documents referred to in them. Nothing in this clause limits or excludes any liability for fraud.
Unless otherwise stated, the copyright and other intellectual property rights in all material on the Website (including without limitation photographs and graphical images) are owned by us or our licensors. For the purposes of this legal notice, any use of extracts from the Website, other than in accordance with these Terms, for any purpose is prohibited. If you breach any of the terms in this legal notice, your permission to use the Website automatically terminates and you must immediately destroy any downloaded or printed extracts from the Website.
Subject to these Terms, no part of the Website may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without our prior written permission. Any rights not expressly granted in these terms are reserved.
22. Service Access
While we endeavour to ensure that the Website is normally available 24 hours a day, we shall not be liable if for any reason the Website is unavailable at any time or for any period. Access to the Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.
The Website is the exclusive property of Discover Dubai Card. Any copying, distributing, transmitting, posting, linking, deep linking or otherwise modifying the Website without the express written permission of Discover Dubai Card is strictly prohibited. Any violation of this clause may result in a copyright, trademark or other intellectual property right infringement that may subject you to civil and criminal penalties.
The Website contains copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound, and the entire contents of the Website are protected by copyright as a collective work under international copyright laws. Discover Dubai a Card own a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. You may not modify, publish, transmit or participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part. Except as otherwise expressly stated under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material without the express written permission of Discover Dubai Card or the copyright owner is permitted. If copying, redistribution or publication of copyrighted material is permitted, no changes in or deletion of author attribution, trademark, legend or copyright notice can be made. You acknowledge that you do not acquire any ownership rights by downloading copyrighted material. Trademarks that are located within or on the Website otherwise owned or operated in conjunction with Discover Dubai Card shall not be deemed to be in the public domain but rather the exclusive property of Discover Dubai Card, unless such site is under license from the trademark owner thereof, in which case such license is for the exclusive benefit and use of Discover Dubai Card unless otherwise stated.
You shall not submit or otherwise make available on the Website any material protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right. Discover Dubai Card does not have any express burden or responsibility to provide you with indications, markings or anything else that may help you in determining whether the material in question is copyrighted or trademarked. You shall be solely liable for any damage resulting from any infringement of copyrights, trademarks, proprietary rights or any other harm resulting from such a submission. If you chose to or are required to make available any material through your use of the Website, you warrant that the owner of such material has expressly granted Discover Dubai Card the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. You also permit any other user to access, view, store or reproduce the material for their personal use. You hereby grant Discover Dubai Card the right to edit, copy, publish and distribute any material made available through your use of the Website.
By posting communications on or through the Website, you shall be deemed to have granted to Discover Dubai Card a royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform, and display the communication alone or as part of other works in any form, media, or technology whether now known or hereafter developed without territorial or time limitations, and to sublicense such rights through multiple tiers of sub-licensees.
24. Law and Jurisdiction
This agreement shall be interpreted in accordance with the English law.
